1. Acceptance of Terms
By accessing or using the digital products and services of DataViz Explorer (“we”, “us”, or “our”), you agree to be bound by these Terms and Conditions (the “Terms”). If you disagree with any part of the terms, then you may not access the service.
2. Digital Products and Delivery
2.1 Nature of Products: All products sold by DataViz Explorer are digital, non-physical goods (e.g., templates, reports, software licenses, downloads). No physical items will be shipped.
2.2 Instant Delivery: Products are delivered instantly upon successful payment to the email address provided at checkout. You are responsible for ensuring your email address is correct and checking spam/junk folders. In the event of non-delivery, you must contact us within seven (7) days of purchase.
3. Payment, Fees, and Final Sale
3.1 Payment Processing: All payments are processed exclusively through PayPal. We do not store or process your financial information. By proceeding with payment, you agree to PayPal’s Terms and Conditions and Privacy Policy.
3.2 Transaction Fees: You acknowledge that PayPal may impose transaction fees which are separate from the product price. We are not responsible for resolving PayPal payment disputes; all such issues must be directed to PayPal support.
3.3 Final Sale Policy: Due to the immediate, irreversible nature of digital downloads, **all sales are final and non-refundable.** We do not offer refunds, exchanges, or credits unless required by applicable law or explicitly stated in a separate, written guarantee for a specific product.
4. Limited Use License
4.1 Grant of License: Upon purchase, you are granted a non-exclusive, non-transferable, revocable license to use the digital product for your personal or internal business purposes only. This license is perpetual (lasts indefinitely).
4.2 Restrictions: You are **strictly prohibited** from: (a) Reselling, redistributing, or sub-licensing the product, in whole or in part; (b) Sharing the product with third parties outside of your immediate organization or household; (c) Using the product in a way that is competitive with DataViz Explorer’s business.
4.3 Customization: You may modify and customize the product to suit your specific needs, but the underlying copyright remains with DataViz Explorer.
5. Disclaimer and Limitation of Liability
5.1 “As-Is” Basis: The products and services are provided “as-is” and “as available” without any warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
5.2 Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall DataViz Explorer be liable for any indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, data, or other intangible losses, arising out of or relating to the use of, or inability to use, the service. Our total liability to you for any and all claims shall not exceed the amount paid by you for the product in question.
6. Miscellaneous
6.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where DataViz Explorer is based, without regard to its conflict of law provisions.
6.2 Severability: If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
6.3 Changes: We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide reasonable notice of any material changes.
